Suicide or Murdered?

“I cannot believe it. He was a good boy,” Mrs. Lita murmured. There was no tears on her face, but she was extremely shocked knowing her son-Jack died that way. It took a few minutes before she cried loudly. Mr. Poe tried hard to calm down his wife.
“It’s impossible. You know... Jack never complained about anything to me. He was just...,” Mrs. Lita told desperately. “So calm... he wasn't a person who said ‘I give up’ easily. It’s unfair...”
Jack, a 18 years old boy, was found died after falling from 13th floor of his apartment. But... He wasn't dying from his falling. Jack’s head got injured from a gunshot. Also... There was a safety net in ground floor for some workers who cleaned up the windows outside the apartment. So he must been safe if he didn't get a gunshot. If you thought he fell down after shooting his head, you must questioned this thing : “Where was the gun he used to kill himself?”
It wasn't found near the place he died (13th floor and ground floor)...
And after the inspection...
The police decided to make Mr. Poe as a suspect. He used his gun to scare Mrs. Lita. But.. unfortunately, the gun which was usually empty, ran out of a bullet straight through his son’s head. Really unpredictable! Mrs. Lita admitted that his husband usually did it –scared her with a gun- when he got upset. Mr.Poe swore that he never meant to kill her. He just used a gun for scaring his wife, so that the gun always been empty. Mrs. Lita told the same. It became complicated since no one knew that there was a bullet in it. So who was the one to blame then?
The inspection continued. And one more clue found, a piece of note in Jack’s room :
